WAIVER OF EXTRADITION

I, __________________________ of my own free will and accord do hereby voluntarily agree and consent to return to the State of Tennessee as a prisoner, to answer to criminal charges of  __________________________ now pending against me. I hereby waive all rights to contest extradition before any Court of competent jurisdiction or otherwise, and consent to accompany Fizer Bonding Co, LLC or his agent, or any authorized representative of the State of Tennessee, as a prisoner and hereby release said representative from any and all liability by reason thereof.

When bail is given, the principal is regarded as delivered to the custody of his sureties (bondsman). Their dominion is a continuance of the original imprisonment. Whenever they choose to do so, they may seize him and deliver him up in their discharge, and if this cannot be done at once, they may imprison him until it can be done. They may exercise their rights in person or by an agent. They may pursue him into another state; may arrest on the Sabbath; and if necessary, may break and enter his house for that purpose. The seizure is not made by virtue of any new process, none is needed. It is likened to the re-arrest by the Sheriff of an escaping prisoner.

1972 Supreme Court Decision in favor of Prather and Rivkin CONTRACTUAL TERMS AND PROMISSORY NOTE 1.l, Fizer Bonding Company, as bail, shall have control and jurisdiction over the principal during the term of which the bond is executed and shall have the right to apprehend, arrest and surrender the principal to the proper officials at any time as provided by law or for violation of any terms of this contract.

2.  It is understood and agreed that the happening of any one of the following events shall constitute a violation of the contract between Fizer Bonding Company and the principal;

a.  If principal shall depart jurisdiction of the court without consent of Fizer Bonding Company,

b.  If principal shall move from one address to another without notifying Fizer Bonding Company,

c.  If principal shall commit any act which shall constitute reasonable evidence of principals' intention to cause forfeiture of said bond,

d.  If principal shall make a material false statement on the application,

e.  If principal shall be incarcerated while under his bond.

3.  Signature of principal is evidence of this agreement that monies paid by him concerning this bond is irrevocable.

4.  Principal and co-principal acknowledge and agree that they are indebted to Fizer Bonding Company, for the previous balance in the amount of $___________ , to be paid in ___________ payments each, to be paid on the ___________  of each week/month. FOR VALUE RECEIVED and in consideration of Fizer Bonding Company making the bond of $____________ the undersigned makers and endorsers  ____________, and ____________, hereby promise to pay to the order of Fizer Bonding Company, together with any assignees hereof or other holder at the office of the holder, the sum of ($________ ) Dollars. This note shall be due upon the conditional forfeiture of the bond of _______________. 

5.  Upon default in the payment of this note, the makers and endorsers agree to pay all costs of collection, including reasonable attorney's fees of 15% in case this note is collected by or through an attorney at law, plus any and all expenses incurred in seeking and/or apprehending the principal.

6.  The makers and endorsers of this note severally waive presentment hereof for payment, protest and notice of non payment and of protest. The holder may extend or postpone payment without and without discharging the undersigned.
